1. Agreement Overview
This Contractor Agreement ("Agreement") governs your participation as a contractor on the Nestimates platform. This Agreement is in addition to our general Terms of Service and Privacy Policy, which also apply to your use of the platform.
By registering as a contractor, submitting estimates, or providing services through Nestimates, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
This Agreement establishes the terms under which you may offer your professional services to homeowners through our platform, including your obligations, our platform fees, and the standards you must maintain.
2. Independent Contractor Status
You are an independent contractor, not an employee of Nestimates. This relationship means:
Independent Status
- You maintain complete control over how, when, and where you perform your work
- You use your own tools, equipment, and materials
- You determine your own pricing and estimate amounts
- You are responsible for your own business expenses
- You may work with other platforms or clients simultaneously
Tax and Legal Responsibilities
- You are responsible for all federal, state, and local taxes
- Nestimates will provide 1099 tax forms as required by law
- You maintain your own business insurance and licenses
- You comply with all applicable labor and employment laws
Nestimates provides the technology platform to connect you with potential clients but does not control the means or methods of your work performance.
3. Contractor Eligibility Requirements
To participate as a contractor on Nestimates, you must meet the following requirements:
Basic Requirements
- Be at least 18 years of age
- Have legal authorization to work in your jurisdiction
- Possess a valid government-issued ID
- Maintain a valid business or personal bank account
- Provide accurate contact information
Professional Requirements
- Hold all required professional licenses for services offered
- Maintain current liability insurance (minimum $1,000,000 coverage)
- Pass background verification checks
- Demonstrate relevant experience and qualifications
- Provide proof of bonding where required by law
Ongoing Verification
- Submit to periodic re-verification of licenses and insurance
- Update credentials promptly when they change or expire
- Maintain good standing with professional licensing boards
- Comply with continuing education requirements in your field
Failure to maintain eligibility requirements may result in account suspension or termination.
4. Platform Obligations and Services

- Performance monitoring and feedback systems
- Safety and compliance guidance
Platform availability is subject to maintenance, updates, and technical requirements. We strive for 99.9% uptime but cannot guarantee uninterrupted service.
5. Contractor Obligations
As a contractor on Nestimates, you agree to:
Professional Conduct
- Conduct business in a professional, courteous, and ethical manner
- Respond promptly to homeowner inquiries and messages
- Provide accurate estimates and project timelines
- Honor commitments made in accepted estimates
- Communicate clearly about project scope, changes, and progress
Service Quality
- Perform work according to industry standards and best practices
- Use quality materials and proper construction techniques
- Complete projects within agreed-upon timeframes
- Address any defects or issues promptly and professionally
- Obtain necessary permits and inspections as required
Platform Compliance
- Keep your profile information current and accurate
- Only submit estimates on projects within your expertise and capacity
- Use the platform's communication and payment systems
- Respect homeowner privacy and property
- Report any safety concerns or issues immediately
Legal and Regulatory Compliance
- Maintain all required licenses, permits, and certifications
- Carry adequate insurance coverage at all times
- Comply with all applicable building codes and regulations
- Follow OSHA safety standards and local safety requirements
- Handle and dispose of materials according to environmental regulations
6. Bidding Process and Project Acceptance
Estimate Submission
- Submit competitive and honest estimates based on project requirements
- Include detailed scope of work, materials, and timeline
- Price estimates fairly according to market rates and project complexity
- Disclose any potential additional costs or change order possibilities
- Respond to homeowner questions about your estimate promptly
Project Acceptance
- Honor accepted estimates for the duration specified
- Begin work within agreed-upon timeframes
- Confirm project details and scope before starting work
- Establish clear communication protocols with the homeowner
- Document project progress with photos and updates
Estimate Modifications and Withdrawals
- Estimates may be modified before homeowner acceptance
- Estimate withdrawals after acceptance may result in penalties
- Change orders must be agreed upon by all parties
- Additional work requires separate agreements and pricing
Frequent estimate withdrawals or failure to honor accepted estimates may result in account restrictions or termination.
7. Service Standards and Quality
Workmanship Standards
- All work must meet or exceed industry standards
- Use appropriate materials for the climate and application
- Follow manufacturer specifications and warranties
- Obtain required permits and pass inspections
- Provide warranties on workmanship as required by law
Customer Service Standards
- Maintain professional appearance and conduct
- Respect homeowner property and privacy
- Clean up work areas daily and upon completion
- Provide progress updates and communicate any issues
- Be punctual for scheduled appointments and work
Safety Standards
- Follow all OSHA safety regulations and guidelines
- Use proper personal protective equipment
- Maintain safe work environments for all parties
- Report accidents and injuries immediately
- Secure work sites to prevent unauthorized access
Quality Metrics
Contractors are expected to maintain:
- Minimum 4.0/5.0 average customer rating
- Project completion rate of 95% or higher
- Response time to messages within 4 hours during business days
- On-time project completion rate of 90% or higher
- Low dispute resolution rates
8. Payment Terms and Platform Fees
Platform Service Fee
Nestimates charges a service fee of 9.9% on all completed projects.
This fee covers platform maintenance, payment processing, customer support, marketing, and dispute resolution services.
Payment Processing
- All payments are processed through Nestimates' secure payment system
- Homeowners see one all-in payment total for their selected payment method before confirming each payment
- Contractors receive payment minus the 9.9% service fee
- Contractor funds remain held until the project is completed and fully paid
- After completion and full payment, contractor funds are released according to the dates and amounts shown for that specific job
Payment Schedule
- Initial Deposit: 9.9% to confirm the selected contractor
- Start Payment: 45.05% before work begins
- Final Payment: 45.05% after work is marked complete
- Change Orders: Separate payment terms as agreed
Fee Structure Details
- Service fee applies to the total project amount including materials
- Card and ACH costs remain recorded internally, while checkout presents the homeowner with one all-in total
- Unreleased contractor funds are frozen when a formal refund, cancellation, dispute, or chargeback case is open
Tax Reporting
- 1099-NEC forms provided for annual earnings over $600
- Detailed transaction history available in contractor dashboard
- Tax reporting based on payments received (net of service fees)
- Contractors responsible for all applicable taxes
9. Insurance and Liability Requirements
Required Insurance Coverage
All contractors must maintain the following minimum insurance coverage:
- General Liability: Minimum $1,000,000 per occurrence, $2,000,000 aggregate
- Professional Liability: Minimum $500,000 (where applicable)
- Workers' Compensation: As required by state law
- Commercial Auto: Minimum $1,000,000 (if using vehicles for work)
- Bonding: As required by local regulations
Insurance Verification
- Provide certificates of insurance during registration
- Update insurance information immediately upon renewal
- Name Nestimates as additional insured where required
- Maintain continuous coverage throughout platform participation
- Submit to periodic insurance verification audits
Liability and Indemnification
- Contractors are solely responsible for their work and its outcomes
- Nestimates is not liable for contractor negligence or errors
- Contractors indemnify Nestimates against third-party claims
- Insurance must be primary and non-contributory
- Contractors waive subrogation rights against Nestimates
Failure to maintain required insurance may result in immediate account suspension.
10. Legal Compliance and Licensing
Licensing Requirements
- Maintain all required federal, state, and local licenses
- Only perform work within your licensed scope of practice
- Renew licenses before expiration dates
- Report any license suspensions or revocations immediately
- Comply with continuing education requirements
Regulatory Compliance
- Follow all applicable building codes and standards
- Obtain required permits for all work
- Schedule and pass required inspections
- Comply with environmental regulations
- Follow OSHA safety requirements
Business Compliance
- Register business with appropriate authorities
- Maintain required business licenses and permits
- Comply with tax obligations and reporting requirements
- Follow employment laws if hiring subcontractors
- Adhere to consumer protection regulations
Reporting Requirements
- Notify Nestimates of any license changes or issues
- Report legal proceedings that may affect work capability
- Update verification documents promptly
- Cooperate with platform compliance audits
11. Dispute Resolution and Mediation
Platform Mediation Services
- Nestimates provides mediation services for project disputes
- Both parties must participate in good faith mediation efforts
- Platform may freeze unreleased contractor funds during dispute resolution
- Resolution timeframe is typically 7-14 business days
- Platform decisions are binding for payment release
Dispute Prevention
- Document all work with photos and detailed descriptions
- Maintain clear written communication with homeowners
- Address concerns promptly and professionally
- Provide detailed contracts and change order documentation
- Follow up on completed work and address any issues
Escalation Process
- Direct communication between contractor and homeowner

- Formal mediation through platform dispute resolution
- Third-party arbitration (if mediation fails)
- Legal action as a last resort
Performance Impact
- Frequent disputes may affect contractor ratings and visibility
- Resolved disputes are noted in contractor performance records
- Unresolved or egregious disputes may result in account action

12. Performance Reviews and Ratings

- Homeowners rate contractors on 5-point scale after project completion
- Reviews include ratings for quality, timeliness, communication, and value
- Written feedback accompanies numerical ratings
- Contractors may respond to reviews professionally
- Reviews are publicly visible on contractor profiles

Violations of confidentiality may result in immediate account termination and potential legal action.
15. Marketing and Promotional Activities

- Nestimates may use contractor profiles in marketing materials
- Project photos may be used in platform promotional content
- Customer testimonials may be featured in advertising
- Contractor success stories may be highlighted
- Performance statistics may be used in aggregate marketing
Contractor Marketing Guidelines
- May reference Nestimates participation in marketing materials
- Must use approved logos and branding guidelines
- Cannot misrepresent relationship with Nestimates
- Must maintain professional standards in all marketing
- Subject to trademark and intellectual property restrictions
Featured Contractor Programs

- Updates to contractor agreement terms as needed

17. General Legal Provisions
